By accessing or using the WatchSecure platform and services, you agree to be bound by these Terms of Service and our Privacy Policy. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Description of Services

WatchSecure provides a security awareness training platform that includes phishing simulation, training modules, compliance reporting, and related services. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time.

3. Account Registration

To use our services, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Be at least 18 years old or have parental consent

You are responsible for all activities that occur under your account.

4. License and Usage Rights

Subject to these terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to access and use our platform for your internal business purposes. This license does not include the right to:

• Sublicense, resell, or redistribute our services
• Modify, reverse engineer, or create derivative works
• Use automated systems to access our platform without permission
• Remove any proprietary notices or labels

5. Acceptable Use

You agree not to:

• Use our services for any unlawful purpose or to harm others
• Send phishing simulations to individuals outside your organization without consent
• Attempt to gain unauthorized access to our systems or other users accounts
• Interfere with or disrupt our services or servers
• Upload malicious code, viruses, or harmful content
• Violate any applicable laws or regulations

6. Payment Terms

Fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We may change pricing with 30 days notice. Failure to pay may result in suspension or termination of your account.

7. Intellectual Property

WatchSecure and its licensors retain all rights, title, and interest in and to our services, including all related intellectual property rights. Your use of our services does not grant you ownership of any content, code, data, or materials you may access.

8. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WATCHSECURE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Termination

Either party may terminate this agreement with 30 days written notice. We may suspend or terminate your access immediately for violation of these terms. Upon termination, your right to use our services ceases, and we may delete your data after a reasonable retention period.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Pune, Maharashtra.
